Delaware requires landlords to give the tenant a free copy of the Delaware Residential Landlord Tenant Code or an eviction challenge by the tenant could be successful.
Deliverance of the notice may be made in person or certified mail. The notice may be posted if the tenant is not present to be served in person.
For default of rent, the Delaware eviction notice is 5 days, excluding weekends. The service date could began the same day as the notice is delivered in person. The notice must include the tenant, the address of the unit, the amount of rent that is due, and that the lease will lapse if full installment is not paid.
The eviction notice is 7 days for those in mobile homes.
For situations where the lease has lapsed or where the inhabitant has a month-to-month rent, the landlord must give a 60-day notice with the notice period starting the day following it is served.
For circumstances where there is a material noncompliance of the rental agreement, for example: having unapproved persons or pets living on the premises, the occupant must be given 7 days to fix the violation. For occupants in mobile homes, the notice period is 10 days.
No notice is obliged if the occupant has done a class B misdemeanor or felony offense that includes brutality to property or an individual.
